Which provides for measures to promote employment of the population. The document is aimed primarily at intensifying the work of the authorities to maximize the assistance to citizens in finding employment, stimulating employment and self-employment of the population. To this end, the Decree entrusts the Government with the tasks of establishing forecast indicators in the field of promoting employment of the population and a list of territories with a tense situation in the labor market, monitoring, assessing the quality and availability of services in the field of promoting employment of the population.

In turn, local authorities will ensure individual work with citizens on the ground in the course of work on their employment and resocialization of persons leading an asocial lifestyle. In addition, the regional, Minsk City Councils of Deputies will be able to additionally allocate funds from local budgets for the implementation of measures to promote employment in areas with a tense situation on the labor market.

The new Decree did not include the norms on the collection of fees from able-bodied non-working citizens to finance public expenditures. At the same time, persons previously recognized as payers of this fee are exempted from paying it.

The Decree provides for a conceptually different approach aimed at stimulating able-bodied non-working citizens to legal employment. It is envisaged that from January 1, 2019, such persons will pay for state-subsidized services at their full cost. The specific list of such services is instructed to determine the Government.

The key role in organizing work to implement the norms of the Decree is assigned to local authorities. To this end, it is envisaged the creation by local executive and administrative bodies of permanent commissions, the main tasks of which are to assist citizens in finding employment.

The commissions will include deputies of all levels, specialists from local authorities, as well as representatives of public associations. As a rule, the chairmen of the Councils of Deputies will head the commissions created at the district level.

The decree gives the commissions broad powers, including making decisions on the release for a certain time of able-bodied citizens who are not employed in the economy from the obligation to pay for services at full cost if they have a difficult life situation.

To implement the Decree, the Government will adopt a number of resolutions, which will, among other things, determine the procedure for classifying able-bodied citizens as not employed in the economy, the list of services provided to these citizens at full cost, the procedure for calculating fees for these services and other issues.

In addition, it is envisaged that the Government will take measures aimed at intensifying preventive work with able-bodied non-working citizens leading an asocial lifestyle; activities of tax authorities to identify and tax the hidden income of individuals.

The decree comes into force after its official publication.

It became known that the President of Belarus January 25, 2018 signed Decree No. 1"On the promotion of employment", which completely changes the previously existing act of legislation.

So, the new decree is actually cancels the previous Decree of the President No. 3.

The main change is that, in accordance with the new Decree will not be charged from able-bodied non-working citizens collection to finance government spending.

Persons who were previously recognized as payers of this fee are exempted from paying it.

However, with January 1, 2019 years, persons previously recognized as "parasites" will pay for state-subsidized services for their 100% cost.

According to the Decree of the Council of Ministers of the Republic of Belarus No. 314 dated April 24, 2018 able-bodied citizens not employed in the economy, pay the cost of utilities that correspond to full refund government costs for the provision of such services, namely:

  • hot water supply
  • heat supply
  • gas supply (in the presence of individual gas heaters)

It is also indicated that commissions will be created that will provide the most individual approach to each citizen.

The commissions will be designed to assist in the employment of non-working citizens.

The work of specially created commissions will be aimed at:

  • job creation
  • employment assistance
  • submission of temporary work
  • retraining

In fact, the part of the article that goes below this one is leveled due to the unexpected signing of Decree No. 1 by the President.

Decree No. 3

In January 2017, the Decree of the President of the Republic of Belarus dated 01/12/2017 "On Amending the Decree of the President of the Republic of Belarus No. 3" was issued. It finalized the Decree of the President No. 3 "On the Prevention of Social Dependency". The head of state explained that he would not collect the fee for 2016 from those who had to pay, and those who paid would not pay for 2017, provided they were employed at work. This decree will not be canceled, but it will be worked out in connection with numerous complaints from citizens.

Who needs to pay the fee?

You need to pay those who have not worked for a year for more than 183 days. Only those who are included in the list of persons, which was recently supplemented by a new decree, do not pay:

  • athletes of the national teams of Belarus
  • students receiving full-time education for the first time
  • Individual entrepreneurs who have paid taxes for more than 20 basic units, established as of January 1 of the corresponding tax period
  • seriously ill
  • people of creative professions who have confirmed membership in the creative union
  • representatives of church organizations
  • officially registered unemployed
  • one of the parents raising a child aged 3 to 7 years who does not receive preschool education
  • military personnel
  • and others (see full list)

Thus, the state fights against those who do not work at all or work “unofficially”.

If you worked less than 183 days a year?

If you worked less than 183 days a year but paid taxes on 20 or more base values ​​(the base value is considered as of January 1 of the year for which you pay the fee), then you are not subject to Decree No. 3. However, if you paid less than 20 base taxes in a year, you only pay the difference between the 20 base rates and the actual amount you paid.

Overpaid (recovered) fees are subject to refund or offset in the manner prescribed by tax legislation.

I'm at work, but I still receive a notice of payment of the fee

As we remember, in 2015, many people received a notice of tax payment. Do not be alarmed, this is a mistake of the tax authority. In this case, if you really worked, then it is enough to take a certificate from the place of work, which certifies the fact of your employment in this organization (company). Next, go to the tax authority that sent you a notice and they will cancel it for you.

No money for tax

In accordance with Presidential Decree No. 3, Local Councils of Deputies or local executive and administrative bodies have the right to exempt from paying the fee due to being in a difficult life situation. This situation is understood as an objective circumstance or a combination of them, which does not depend on the citizen, and he cannot overcome it at the expense of available funds (for example, the death of a spouse, inability to self-service).

Has the law affected unemployment?

In general, the number of unemployed in 2017 decreased compared to 2016. Unemployment was 0.6%, and in 2016-0.8%. Also, the demand for labor has increased, citizens have begun to apply more often to the bodies for labor, employment and social protection of the population. Commissions of local importance

The entire burden of implementing the norms of the decree is shifted from the tax authorities to the local authorities. To do this, the executive committees will create permanent commissions, which will include deputies of all levels, representatives of local authorities and public associations. These commissions will be chaired by the chairmen of the councils of deputies.

Such commissions will have two key tasks. The first is to assist citizens in finding employment, the second is to compile lists of citizens who can, but do not want to work. From January 1, 2019, such persons will pay for state-subsidized services at full cost. The specific list of services is instructed to determine the government. However, it is already known that non-working citizens will lose subsidies for utility bills and will pay 100% for healthcare and education.

Commissions of local executive committees will also decide whether a citizen really does not want to work (leads an asocial lifestyle) or if he finds himself in a difficult life situation, and therefore may not pay for social services at full cost. Also, local authorities will have to work individually with citizens on the issue of their employment.

At the same time, the government of the country must adopt a number of resolutions, which will, among other things, determine the procedure for classifying able-bodied citizens as not employed in the economy, a list of social services provided to these citizens at full cost, and the procedure for calculating fees for these services. Also, it is the government that must figure out how to occupy unemployed citizens in the regions - the Council of Ministers has already been ordered to set forecast indicators in the field of promoting employment.

The decree also singles out "problem areas" - depressed regions of Belarus in which there are no operating industries, and hence jobs outside of budgetary organizations.

During the year, the government should decide on measures for the economic development of such regions, primarily through support for local small and medium-sized businesses. In turn, the regional councils of deputies will be able to additionally allocate funds from local budgets to activities to promote employment in areas with a tense situation on the labor market.

How it was

The Decree “On the Prevention of Social Dependency” was signed by Alexander Lukashenko in April 2015. The document provided that citizens who do not work more than 183 calendar days a year must pay 20 basic units to the budget. At that time, it was an amount of 360 Belarusian rubles ($180).

At first, the document was not taken seriously in society - until December 2016, when the tax inspectorates sent out about 470 thousand notices about the need to pay the “parasitism tax”.

It turned out that Decree No. 3 actually introduced a tax on the unemployed. This swept across the country in February - March 2017. Only 54 thousand people out of 470 thousand paid the prescribed amount.

On March 9, 2017, the decree was suspended, and at a government meeting, Lukashenka announced that the fee would not be collected from the unemployed for a year. The tax authorities were instructed to return the money to those who had already paid the “parasitism tax”. Simultaneously the president of all the unemployed.

At the same time, a radical revision of the document began, which resulted in the appearance of Decree No. 1.

Questions remain

“The most important thing that remains incomprehensible is how the requirement for the unemployed to pay, for example, medicine fits in with the Constitution, according to which state medicine is free for all citizens, without any distinction? Or education - the child of non-working parents, it turns out, will not be taken to a free school? - noted in an interview with RT Belarusian politician, leader of the International Center for Civil Initiatives "Our House" Olga Karach.

She clarified that Article 41 of the Belarusian Constitution directly prohibits the use of forced labor, and this provision is contained in many international agreements signed by the republic.

“And here, it turns out, we see forced labor. So far, there is no clarity on how the government will resolve these contradictions,” Karach stressed.

Another important question, according to experts, is how realistic it is to employ everyone. Despite the measures taken by the government, data from the state statistical agency (Belstat) show that in January-September 2017, 4,351,800 people were employed in the Belarusian economy. This is almost 65 thousand (1.4%) less than in the same period last year.

"Who should pay the fee for financing public expenditures and in what amount?".

– A Presidential Decree* establishes such an obligation for citizens of the Republic of Belarus, as well as foreign citizens permanently residing in the republic and stateless persons who did not participate in the financing of public expenditures or participated in such financing for less than 183 calendar days in the past year. The amount of the fee is 20 base units**.

“My mother is a disabled person of the 1st group, now I draw up documents for caring for a disabled person. Do I have to pay tax for parasitism?

- The period of participation in the financing of public expenditures includes the period of receiving benefits from the republican budget, the budget of the state non-budgetary fund for social protection of the population. Therefore, the time you received the allowance for the care of a disabled mother of group I will be included in the period of participation in the financing of public expenditures. If you did not receive a benefit in 2015 or otherwise contributed to government spending, you will be a levy payer for 2015.

“My son is studying abroad, but he received a notice to pay the fee. I called the tax office and explained that my son was studying at a university abroad. The tax inspectorate recommended submitting a certificate from the educational institution stating that in 2015 he studied full-time. Why does my son have to provide it himself, why can't the inspection make an appropriate request? Is it possible to submit this certificate in a foreign language?

- A citizen who has received a notification has the right to submit documents or explanations indicating that he has no obligation to pay the fee or that the fee has been incorrectly calculated. To confirm the fact of receiving full-time education or to confirm staying in a foreign country for more than 183 days, your son must provide such documents and or explanations.

It should be clarified that information on the education of citizens in Belarusian educational institutions is submitted to the tax authorities. But information about the period of study in 2015 at a foreign university can only be provided by the citizen himself or his representative. Documents submitted to the tax authorities in a foreign language must be accompanied by a translation into Belarusian or Russian.

“In February 2015, I quit my job. I decided to take up craft activities and on May 2, 2015 I paid a fee of 1 base unit. Why did I receive a notice to pay the fee?

– The period of participation in the financing of public expenditures in 2015 includes the period of handicraft activities, subject to payment of the fee for the implementation of handicraft activities for the full tax period within the period established by law for paying this fee for each subsequent calendar year.

Payment of the fee for the implementation of handicraft activities for each subsequent calendar year is made no later than the 28th day of the last month of the current calendar year in which handicraft activities are carried out.

You paid the fee for the implementation of handicraft activities on May 2, 2015, that is, for the period from May 3 to December 31, 2015. Therefore, the period of your handicraft activities in 2015 is not included in the period of participation in the financing of public expenditures in the same year, since payment of the fee for the implementation of handicraft activities in 2015 must be made no later than 12/29/2014, that is, for the full tax period (2015).

Thus, you are recognized as the payer of the fee for 2015.

“My son served in the army in 2015. Does he have to pay a fee?

– If your son was in the military for at least 183 days in 2015 or otherwise participated in the financing of public expenditures, then he will not be recognized as a payer of the fee for financing public expenditures.

“What will happen if, having received a notice of tax payment, I do not pay it, because, according to the law, I fall into the category of those who are exempt from paying it? I don’t want to waste time proving my right to be released.”

- A citizen who has received a notice has the right to submit documents or explanations to the tax authority within 30 calendar days, indicating that he has no obligation to pay the fee for the relevant tax period or that the tax authority has incorrectly calculated the amount of the fee.

If such explanations are not provided by a citizen, then he is obliged to pay the amount of the fee calculated for payment within the period established by law. For non-payment or incomplete payment of the amount of the fee, administrative liability is provided in the form of a fine in the amount of 2 to 4 basic units or administrative arrest. Collection of fees in this case will be made in a compulsory manner.

“I have a disability certificate. Disability has not been extended, but it has not been removed in the manner prescribed by law, that is, there is no examination and conclusion of the MREK. Do I need to pay a fee?

– In accordance with the norms of the Decree, citizens who were recognized or were disabled in the tax period, and were also recognized as disabled in the year following the tax period (regardless of the group, reason, date of onset and duration of disability) are exempted from paying the fee. Thus, if you were disabled in 2015, you are exempt from paying the fee to fund government spending.

“For health reasons, I can’t work, I am periodically treated in the hospital, my husband supports me. Doctors have not been able to establish the cause of the ailments for several years, therefore I cannot document the incapacity. Due to the fact that I did not have a job in 2015, I was not issued sick leave. The doctors advised me not to work. Is it possible to exempt me from paying the fee in this situation?

– The period of participation in the financing of public expenditures includes a period of temporary incapacity for work, confirmed by a certificate of incapacity for work (certificate of temporary incapacity for work) or its duplicate. If you cannot confirm the fact of incapacity for work, you will be recognized as the payer of the fee.

It should be noted that any law establishes general duties for all, without taking into account the peculiarities of specific life situations. In this regard, the Tax Code of the Republic of Belarus grants the right to local Councils of Deputies or, on their behalf, to local executive and administrative bodies, to exempt individual payers from paying taxes based on their property status. Therefore, in order to be exempted from paying the fee, you have the right to apply with an appropriate application to the executive and administrative body at the place of residence.
